Cool... I think.
While it's great to see such a public acknowlegement of the strides Linux has made, it's a mixed bag. After all the whole reason Microsoft is making this statement is that they think the world (and the SEC) can now be convinced that they are no longer a monopoly. Unfortunately that's one of those terms that can never be fully defined and yet requires a legal definition. We all know what it means in theory, but in practice it's very difficult to nail down. There's a constant political tug-of-war that goes on with these things. I don't see any way around that since obviously the situation is constantly evolving.
Personally, I think too much emphasis is placed on the term itself. That said I think the people who actually deal with these issues (lawyers on all sides, the SEC, DOJ, et al) are quite aware of that and it's not so much a hangup for them. Still, as a political process it's heavily influenced by public opinion, so public perceptions are quite relevant no matter how distorted they may be.
